1. Acceptance of Terms
By downloading, installing, accessing, or using Sigilmon (“the Game”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Game. These Terms constitute a legally binding agreement between you and Crux Coast (“Crux Coast”, “we”, “us”, “our”), the publisher of the Game.
We reserve the right to modify these Terms at any time. Your continued use of the Game after changes are posted constitutes your acceptance of the revised Terms.
2. Account Creation and Eligibility
You must be at least 13 years of age to create an account and use the Game. In Australia, users must be at least 15 years of age due to the presence of simulated loot box mechanics. By creating an account, you represent and warrant that you meet the applicable minimum age requirement in your jurisdiction.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You may not share, sell, transfer, or allow others to access your account.
3. Virtual Currency and Purchases
The Game may offer virtual currency (“Gems”) and other virtual items that can be purchased with real money or earned through gameplay. All virtual currency and virtual items are licensed to you, not sold. You do not own any virtual currency or items; they remain the property of Crux Coast at all times.
All purchases of virtual currency are final and non-refundable, except where required by applicable law (including Australian Consumer Law). Virtual currency and items have no real-world monetary value, cannot be exchanged for real currency, and are non-transferable between accounts.
The Game includes gacha mechanics (randomised virtual item draws). The odds for each tier of reward are disclosed before every purchase, in accordance with applicable regulations.
4. User Conduct
You agree that you will not:
- Use cheats, exploits, automation software, bots, hacks, mods, or any unauthorised third-party software to modify or interfere with the Game.
- Harass, threaten, bully, or engage in abusive behaviour toward other players.
- Impersonate any person or entity, or falsely represent your affiliation with any person or entity.
- Attempt to gain unauthorised access to other accounts, systems, or networks connected to the Game.
- Engage in any activity that disrupts, damages, or impairs the Game or its servers.
- Use the Game for any illegal purpose or in violation of any applicable laws or regulations.
Violation of these conduct rules may result in temporary or permanent suspension of your account, at our sole discretion.
5. Intellectual Property
All content in the Game, including but not limited to graphics, art, text, music, sound effects, game mechanics, software code, creature designs, and user interface elements, is owned by or licensed to Crux Coast and is protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Game for personal, non-commercial purposes. You may not copy, modify, distribute, sell, lease, or create derivative works based on the Game or its content without our prior written consent.
6. Disclaimer of Warranties
THE GAME IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE GAME WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT DEFECTS WILL BE CORRECTED.
To the maximum extent permitted by applicable law (including the Australian Consumer Law), we disclaim all warranties relating to the Game. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee or right under the Australian Consumer Law or any other applicable law that cannot be excluded, restricted, or modified.
7. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CRUX COAST, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE GAME.
Our total liability to you for all claims arising out of or relating to the Game shall not exceed the amount you have paid to us in the twelve (12) months immediately preceding the event giving rise to the claim.
8. Termination
We may suspend or terminate your account and access to the Game at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to, breach of these Terms, abusive behaviour, fraudulent activity, or extended periods of inactivity.
Upon termination, your right to use the Game ceases immediately. Any virtual currency, items, or progress associated with your account may be forfeited. We are not obligated to provide refunds for any purchases made prior to termination, except where required by applicable law.
9. Changes to Terms
We reserve the right to update or modify these Terms at any time. If we make material changes, we will notify you through the Game or via email. Your continued use of the Game after any changes constitutes acceptance of the new Terms. We encourage you to review these Terms periodically.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of New South Wales, Australia, without regard to conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
